2022 State Weed Grant - Permission to Access & Treat on Private Land

Use this form to allow access to your property for the purpose of assisting in the 2022 State Weed Grant, a collaboration between Yamhill, Marion, and Polk Soil & Water Conservation Districts. For this grant the weeds included are Garden Yellow Loosestrife, Yellow Floating Heart, and Water Primrose.

  • Noxious weeds are destructive to agriculture, forestry, recreation, wildlife, public health, and can decrease property values. Early detection and removal is the most effective way to control high priority or newly emerging noxious weeds. Noxious weeds may be growing along the stream or waterbody on or near your Property. A partnership between Yamhill, Marion, and Polk Soil and Water Conservation Districts, Greater Yamhill Watershed Council (GYWC), Oregon State Weed Board and Oregon Watershed Enhancement Board works to protect natural resources and working lands by controlling priority noxious weeds. By signing below, you certify that you own the Property described above and that you expressly grant permission to YSWCD, its partners, contractors, and their respective agents, to access or cross the Property on foot or by vehicle to perform any or all the following tasks:
    1. Conduct plant surveys to determine the presence of priority invasive weeds on the Property or on land accessed by crossing the Property. (If access requires crossing a neighbor’s property, the YSWCD will obtain the neighbor’s permission separately.)
    2. Treat any target invasive plants using methods determined by the YSWCD to be appropriate. This may include hand removal and/or application of herbicides on one or more dates and at one or more locations on the Property.
    3. Perform inspections and follow-up monitoring as needed to evaluate the effectiveness of the treatment.
    4. Perform follow-up treatments as needed.
    The Landowner will be notified in advance if any work is to be performed involving a contractor hired by the YSWCD or its partners. The YSWCD, contractors or partners will contact the Landowner prior to visiting the Property and all visits will be made according to an agreed-upon schedule. The Landowner acknowledges that information relating to the work, including effectiveness monitoring data is a public record. The Landowner, the YSWCD, its partners and contractors will each be responsible for their respective acts and omissions and for those of their respective representatives, and will be liable for any damage or liability which may arise therefrom, subject to the limitations and conditions of the Oregon Tort Claims Act, ORS 30.260-30.300, and the Oregon Constitution. This document absolves the Landowner from all liabilities related to actions conducted by the YSWCD, its partners, contractors, and their respective agents. This agreement shall be effective upon signing by both the Landowner (or Authorized Representative) and the YSWCD. The permission granted by this agreement shall be continuing unless revoked by the Landowner in writing.
